Controversial construction union boss John Setka has declared victory in his damaging poaching war with the national head of his union after recruiting more than 200 members from a rival faction.

The Federal Court on Monday dismissed Construction, Forestry, Maritime, Mining and Energy Union national secretary Michael O'Connor's bid to restrain Mr Setka's Victorian construction branch from enrolling floor layers, glaziers and cabinet workers from Mr O'Connor's manufacturing division.
