BHP will seek to invoke an exemption in Labor’s same job, same pay laws to ward off a potentially billion-dollar cost impost from the mining union’s landmark case against its in-house labour hire companies.

The mining giant revealed on Thursday it would argue its targeted subsidiaries Operation Services were “service contractors”, not labour hire, under a legal exemption won by the resources and energy employer group.
