Super boards can rely on ‘reasonable’ outside advice: court
The Federal Court has thrown out the corporate watchdog’s claims that $86 billion industry superannuation giant Rest misled customers about their rights to leave, ruling the fund justifiably relied on legal advice that their practices were acceptable.
The Australian Securities and Investments Commission alleged Rest told customers who wanted to take their savings elsewhere that they needed to keep $5000 in their REST account if their employer wanted to keep making contributions.
