Hemmes wins Establishment trademark dispute

Pub and restaurant owner Justin Hemmes has won his trademark dispute against a wealthy Brisbane cattle family, successfully arguing their new “Establishment 203” restaurant was deceptively similar in name to his marquee Sydney bar.

The Federal Court sided with Hemmes Trading, which sued the upmarket Italian and steak restaurant in Fortitude Valley, claiming it infringed the trademark Mr Hemmes owned over The Establishment in Sydney.
