Courts combine for historic class actions appeal

A historic joint sitting of two of the nation's top courts will hear a class actions appeal on Monday, with the right of litigation funders and law firms to charge fees at stake.
The Full Federal Court and the NSW Court of Appeal will examine the constitutionality of "common fund orders" in actions brought against Westpac, over life insurance premiums, and BMW, over faulty airbags.
