The Federal Court and the NSW Supreme Court will break new ground with a joint sitting to hear two appeals over "common fund" payments for the costs of running a class action.
Six judges will be on the bench – three from each court – in February as Westpac and BMW challenge provisions which allow plaintiff law firms and litigation funders to charge all members of a class, not just the ones they sign up.
