High Court victory for ‘Botox alternative’

A small Australian cosmetics company has won a six-year legal battle with the worldwide supplier of Botox, Allergan, which wanted to stop it from marketing one of its products as “an instant Botox alternative”.
The High Court last week sided with Self-Care Corporation and its “Freezeframe” brand as it overturned a Full Federal Court and found it had not infringed Allergan’s trademark or breached Australian consumer laws.
