Jayden Guy, McDonalds manager accused of indecent filming, asks for phone

He was denied access to the internet on his phone while facing allegations he filmed young girls changing at a McDonald’s, now this man wants his phone so he can find a job.

A Salisbury Heights man accused of filming young girls changing in the workplace, where he was a manager, has pleaded with the court to access the internet on his phone so he can get a job.

Jayden Guy, a 25-year-old McDonald’s manager, first faced court in March last year on 36 counts of indecent filming without consent, one of which related to a girl under 17.

Mr Guy was released on home detention bail late last year on the charges before he was arrested again on charges in breach of that bail.

Facing court in April, Mr Guy was accused of being caught with an internet enabled phone while in home detention, and that he falsified documents in an attempt to have a working with children prohibition stemming from the charges revoked.

The Elizabeth Magistrates Court on Monday heard that accusation resulted from an alleged attempt to alter a certificate of record for the court to send to a prospective employer.

It was revealed in April those alleged falsifications happened with him in pursuit of a job with Timezone at Tea Tree Plaza.

Oliver Cole, for Mr Guy, told the court his client was having difficulty applying for jobs through a job agency as a result of not having a phone with an internet connection.

He also said Mr Guy needed internet access on his phone for internet banking.

Mr Guy himself told the court he had not used the internet while on bail, something Mr Cole said was “out of an abundance of caution”.

“I haven’t used the internet the entire time I’ve been on home detention,” Mr Guy said.

The police prosecutor said the bail condition was likely put in place to prevent any images being uploaded to the internet, though Mr Cole said there was no allegation Mr Guy had been uploaded footage.

Magistrate Justin Wickens considered the impact of changing the bail condition, but said it could be difficult to police.

“He could use the internet on a personal computer and not be in breach of either of these bail orders, is that correct?” he said.

“So he can do his internet banking at home, on his laptop, but he can’t do it on his phone.

“I can’t see any good reason for the condition that he be in possession of a non internet enabled mobile phone in this day and age, what does that possibly stop you from doing?”

Mr Wickens made no decision on the variation, adjourning the matter until November and telling Mr Cole to submit a refined variation application.
