Father's Day brawl erupts at Midway Tavern between two families

A man who stabbed two brothers at the Midway Tavern during a “fast moving and violent” brawl has been jailed for more than eight years.

Jacob Anthony Donhardt, 24, escalated the fight between feuding families by brandishing a flick knife and stabbing Nicholas and Jordan Feast on September 6, 2020.

During sentencing on Tuesday, the District Court heard Donhardt and his family arrived at the Midway Tavern and started playing pool.

They were approached by the victims’ father, Matthew Feast who asked if he could join the game.

The court heard Donhardt’s mother became enraged during the interaction and threw her pool cue onto the table.

One of the Feast family yelled profanities to Donhardt’s mother and a physical altercation kicked off.

Donhardt came towards Matthew with a pool cue, who grabbed hold of his shirt.

“You swung the cue and hit him over the head several times, causing the cue to snap in half,” Judge Anthony Allen said.

The court heard Donhardt’s stepfather, Garry Frost then hit Matthew to the back of his head.

Nicholas ran to the group and allegedly punched Donhardt’s stepfather to the face several times, before a brawl broke out between the families.

Donhardt then brandished a flick knife.

Jordan had been outside having a cigarette when the brawl broke out.

“He attempted to break up the fight … while Jordan Feast pushed you out of the western door, you stabbed him to the face and arm,” Judge Allen said.

Judge Allen said the photographs of the injuries, which included lacerations to Jordan’s cheek and forearm, were “quite shocking”.

Donhardt was chased by the brothers to the carpark.

Nicholas grabbed Donhardt by the shirt and a fight ensued – with Donhardt stabbing him to the stomach and collarbone.

“You said ‘back off or I’m going to kill you’,” Judge Allen said.

The court heard Donhardt left and returned to the venue with different clothing and was arrested by police.

Judge Allen said the fast moving and violent altercation was over in six minutes.

Donhardt, of Elizabeth Park, pleaded guilty to two counts of causing harm with intent.
No other charges emerged from the incident.

In their victim impact statements, Jordan said he was scared he was going to die during the attack and was left with permanent scars.

Nicholas said he is now much less outgoing and wary about strangers.

Donhardt had only been given a suspended sentence for committing a knifepoint robbery four weeks before the offending.

The court heard Mr Frost passed away in July 2022, with Donhardt telling a psychiatrist he died from a stroke whilst driving as a result of the head injuries he sustained on the night.

Judge Allen said Donhardt’s decision to use the knife was grossly disproportionate and extremely dangerous and without rehabilitation, he remained at significant risk of violent reoffending in the future.

Revoking Donhardt’s suspended sentence bond, Judge Allen sentenced him to a total of eight years and two months jail, with a non-parole period of four years and eight months.

“The danger of the use of a knife in a licensed premises is self-evident in what came to pass this Father’s Day afternoon,” he said.

The sentence was backdated to September 7, 2020.
