David Jenkins murder: Patrick Dolbey’s lawyer wants to cross-examine 10 witnesses

Two of the three people accused of murdering a Tasmanian father by stabbing him to death in a street fight have appeared in court. One of the defendants is set for lengthy preliminary proceedings.

The lawyer for one of three men charged with murdering a Tasmanian father by stabbing him to death in a street confrontation has told a court she intends on cross-examining 10 witnesses in preliminary proceedings.

George Town trio Patrick Kenneth Dolbey, 37, Luke Anthony Shaw, 30, and Paul William Shaw, 32, were charged conjointly with murdering Mount Direction father-of-two David Jenkins, 34.

Mr Jenkins was discovered with stab wounds on Lambert St, George Town, on the evening of October 22 last year.

A West Launceston duo, Belinda Jayne Cox, 50, and Brett James Dilger, 58, were subsequently charged with being accessories after the fact to murder. They are alleged to have harboured Luke Shaw, who was arrested at Launceston Airport the day after Mr Jenkins’ death as he tried to board a flight interstate.

Dilger, Luke Shaw and Dolbey all appeared in Launceston Magistrates Court on Tuesday.

Defence lawyer Fran McCracken, representing Dolbey, told the court she had applied to cross-examine 10 witnesses in a preliminary proceeding (where the strength of the evidence is tested and a magistrate determines whether the matter should be committed to the Supreme Court).

She told the court that her client’s charges had not yet been assigned to a prosecutor. It was hoped this would happen next week. The Crown cannot agree to the cross examinations until a prosecutor is assigned.

Dolbey’s charge of murder was adjourned to March 7, as was Luke Shaw’s.

The court heard documents relating to Shaw’s charge had been provided to Hobart criminal barrister Garth Stevens, who was still considering the defence position.

Dilger’s charge of accessory after the fact was also adjourned to that day.

Defence lawyer Hannah Goss told the court she had only just received a “large amount of disclosure” (i.e. the Crown case against her client) and needed time to consider her position.

The other defendant charged with murder, Paul Shaw, will appear on March 7 too.

Cox has already been committed to the Supreme Court. She appeared in late January.
