Travis Kelvin Mozer faces Gatton Magistrates Court for drunk cycling
A Gatton man that was so drunk he fell from a bicycle called his charge a ‘frivolous waste of the court’s time’. A magistrate disagreed.

A Gatton man caught drunk cycling, and blew 0.155 when stopped by police, called the charges against him “an absolute frivolous waste of the court’s time”, prompting a stern dressing down from the magistrate.
Travis Kelvin Mozer, 21, appeared in Gatton Magistrates Court on Monday where he pleaded guilty to attempting to put in motion any horse, animal or vehicle (other than a motor vehicle) under the influence.
Police prosecutor Sergeant Narelle Lowe told the court that about 11pm on August 3 this year police were called after a man was seen riding a bicycle through Gatton and appeared under the influence of alcohol.
Sgt Lowe said when police went to Railway Street they saw the man fall off the bike and he was stopped, where he was found with just one shoe and cuts to his leg.
The court was told Mozer identified himself and told police he had consumed a large quantity of alcohol that evening.
Sgt Lowe said after a positive roadside test he was arrested and taken back to Gatton Police Station where he blew 0.155.
Mozer, who was representing himself, told the court that the charges were “an absolute frivolous waste of the court’s time.”
“Well it’s not,” magistrate Roger Stark replied.
“It’s not a waste of time because you were on the road. Other cars may have had to take evasive action to avoid you because your ability to ride was grossly affected by your level of intoxication, so you were a danger to others.
“You were also a danger to yourself, that’s why it’s not a waste of time.”
Mozer was fined $500, and no conviction was recorded.
