Toowoomba tradie guilty of ”abhorrent” domestic violence crimes

A Toowoomba tradesman well versed with the courts has added “abhorrent” domestic violence crimes to his 17-page rap sheet.

A Toowoomba man with a lengthy criminal history for drug-related crimes has added domestic violence offences to his 17-page rap sheet.

At the Toowoomba Magistrates Court on Tuesday, May 6, Bryton Paul Delaney pleaded guilty to 23 drug, domestic violence, driving, and bail-related crimes via video link from the watch house.

The court heard the 33-year-old pool builder spent a number of stints in custody on remand for the various offences over the past year or so, totalling 183 days.

Police prosecutor Sergeant Alistair Windsor said the most serious charges before the court were Delaney’s two assault charges from 2024, which were committed against his ex-partner while a domestic violence order was in place.

Sergeant Windsor said the violence Delaney imposed, physical and verbal, had a detrimental effect on the woman and had caused her significant fear.

He said the court must take a strong stance and condemn violence, especially when it is committed in a domestic violence setting, and said a 12-month jail term was within range for Delaney’s crimes.

Other offences the father was before the courts for, included the dangerous operation of a car on the Warrego Highway in April 2024, where her also failed to stop for police.

This year, Delaney was charged with a number of bail breaches, which were placed on in December, which included not charging his ankle monitoring device and failing to report to police.

In April, police also caught Delaney driving with meth in his system twice, and was found in possession of the insidious drug as well as cocaine.

Magistrate Kay Ryan told Delaney his actions towards his ex-partner were abhorrent, noting domestic violence was a looming concern for the community.

She said at one stage, as it was likely a higher statistic now, that at least two Australian women were killed every week in a domestic and family violence setting.

“I’m not saying that’s what would occur here. But I just want to impress on you the seriousness of how these things can get out of hand… with very serious consequences both for yourself and the victim,” she said.

Delaney was sentenced to a 12 month jail term and had his licence disqualified for six months.

The 182 days spent in custody were declared as time served, and he was released on parole, after pleading guilty to the following crimes:

Assault (DV), assault occasioning bodily harm (DV), breaching a DVO multiple times with the aggravate of assault, failing to stop for police, dangerous operation of a car, breaching his bail conditions, obstruction police, possessing meth, possessing cocaine, and possessing a drug pipe.

Upon his release, Delaney intends to check himself into a rehabilitation facility and instructed his solicitor that he wasn’t going back to the “toxic” relationship.
