A police raid on the motel room of a man suspected of being part of the burglary of a rural property ended in a disturbing discovery, a court has been told.

Toowoomba man Bryton Paul Delaney was captured on CCTV involved in a burglary of a property in Meringandan on May 21, 2021, where a quantity of cash and a gaming console was stolen, Toowoomba Magistrates Court was told on Friday.

As part of their investigations, on July 30 police executed a search warrant on a motel room that the 30-year-old and his girlfriend were staying in.

Police prosecutor Senior Constable Chris Willson said along with a quantity of drugs and drug items, police discovered a stolen shortened firearm, ammunition and knuckledusters as well as $1130 suspected to be the proceeds of a crime.

During the search police also found a video on Delaney’s mobile phone of him brandishing the weapon, making various threats to members of the public.

The following month on August 18, while Delaney was in custody, police performed a search of his home address which uncovered a quantity of steroids.

In court Delaney pleaded guilty to 12 offences, including enter dwelling and commit indictable offence, possessing a shortened firearm, possessing dangerous drugs and possession of property suspected of being the proceeds of an offence.

Delaney’s solicitor Brad Skuse said his client’s criminal history was indicative of someone who had a struggle with drug addiction “for a considerable period of time”.

The court was told Delaney’s mother was in support of her son in the court, and that upon his release he would be able to live with her, with Mr Skuse submitting that an opportunity to address his drug issues would “lessen the prospects of him committing further offences”.

A father of one, Mr Skuse said his client had been picking up some skills as a painter, as he and other inmates had been working to repaint Borallon Training and Correctional Centre.

Magistrate Clare Kelly sentenced Delaney to 15 months behind bars, but with 364 days of pre-sentence custody declared as time served Ms Kelly ordered that Delaney would be immediately eligible for parole.

“You obviously need to change the way you’re living if you want to stop being in custody, the matters on your criminal history are really quite serious,” the magistrate said.
