Toowoomba man Aaron Brett Duncanson sentenced in court for spitting incident

A domestic violence offender breached his suspended sentence by verbally abusing and spitting on a man.

A court has been told a Toowoomba man carrying out his jail term within the community breached a court order by verbally abusing and assaulting a man.

Aaron Brett Duncanson fronted Toowoomba District Court on June 23, for breaching his sentence which was imposed more than a year ago when he was convicted of seriously assaulting an ex-partner.

Duncanson punched the woman in the face causing damage to her face and teeth.

Duncanson was sentenced to a nine month jail term, suspended for 18 months, and breached it after 11 months of good behaviour.

The court was told Duncanson was feuding with a man, who would routinely film him, which escalated to physical violence when Duncanson spat on the man’s chest and called him a “paedophile”.

Judge David Kent KC told Duncanson it was clear he needed to stay away from alcohol.

“As unappealing as reality can be, we just need to grapple with it,” he said.

Judge Kent KC said the breach was proved and extended the operational period of his suspended sentence for an additional year.

In March, Duncanson pleaded guilty to the assault and public nuisance charge, and was sentenced to a nine month jail term, suspended for 18 months.

He also spent three nights in police custody at the watch house following the incident.
