NAMED: Alleged Toowoomba car thief Dylan Wippel granted bail after arrest

Named: A Toowoomba man who police allege was involved in a break-in that resulted in a car being stolen and burnt out, has been released back into the community.

A young Toowoomba man arrested at the weekend for his alleged involvement in a break and enter that resulted in a car being stolen and burnt out, has been released on bail back into the community.

Toowoomba Magistrates Court was told 23-year-old Dylan Wippel was arrested alongside juveniles and charged with a raft of property offences.

Police charged Mr Wippel with 10 offences which included entering a home with intent, unlawful use of a car, and the arson of an alleged stolen car.

The young man’s charges were first mentioned on Monday, June 3, however his bail application was adjourned so his mental health could be assessed by a doctor following an incident at the watch-house.

As a result of the incident, Wippel was also charged with obstructing police, and assaulting a police officer and watch-house staff.

The court was told at the time of the alleged offending Wippel was coming down from a meth “bender” and had not been taking his prescribed medication olanzapine.

olanzapine is often used to treat schizophrenia and bipolar disorder.

During Mr Wippel’s successful bail application on Wednesday, June 5, solicitor Michael Corbin said he received instructions that some charges may be contested.

He noted Mr Wippel was not in breach of any bail or court orders when the alleged offences occurred.

Police prosecutor Jessica Lynch said police opposed Mr Wippel being released given his lengthy criminal history and because the alleged crime happened weeks after his suspended sentenced came to an end.

He was placed on a suspended sentence for property offences including entering homes and unlawful use of motor vehicles.

Sergeant Lynch said the bail conditions submitted by Mr Corbin were unlikely to mitigate the risk to the community.

Magistrate Kay Ryan said Wippel was in a position where he was entitled to bail by law, unless police proved he posed an unacceptable risk of offending.

After reviewing the bail act, Ms Ryan granted the bail application with “strict conditions” including a curfew between 9pm and 7am, a non-contact order in regards to the alleged co-offenders, and ordered him to attend a GP to keep his mental health on track.

“You’ve got no failures to appear on your history and it’s not said that you would fail to appear in court,” she said.

“You do have the support of your aunty.

“If I were to refuse you bail I have to consider the effect that would have on you and your extended family.”

She noted since the young man’s arrest he recommenced taking his olanzapine medication.

Sergeant Lynch asked for police prosecution to be provided with his mental health review and proof of his mental health diagnosis.

The case will next be before the court on July 17, 2024.

A full brief of evidence was ordered.
