Isaac Zane Cubby charged with murder by the court

The 18-year-old was not required in court when the charge was formally upgraded to murder. See what happened in court:

A teenager accused of knocking over Robert Brown at a taxi rank near Grand Central Shopping Centre leaving him with serious injuries has formally had his charge upgraded to murder.

Isaac Zane Cubby, 18, has been remanded in custody since his arrest on February 7 and was not required to be in Toowoomba Magistrates Court for the brief mention of his matters on Monday when the charge of grievous bodily harm was replaced by a charge of murder.

The upgraded charge comes after the death of Mr Brown who had not regained consciousness since the alleged incident on the afternoon of February 6.

Cubby has not yet been required to enter pleas to charges of murder, robbery with violence, unlawful use of a motor vehicle and entering a dwelling with intent.

His solicitor Ryan McCullough, of MacDonald Law, told the court on Monday this was the first mention in court of the charge of murder and that a police brief of evidence would be sought.

His client’s other charges were next scheduled for mention in the same court on March 28, he said.

Magistrate Louise Shephard remanded Cubby in custody and adjourned his matters for committal mention back in the same court on March 28.

Two co-accused teenagers, a 17-year-old Dalby boy and a 17-year-old Harlaxton boy, who were initially charged over the incident, will have their charges upgraded to murder in the Toowoomba Childrens Court.
