Dwayne Donald Hall jailed for police pursuit through Brisbane car park complex after sentenced in Toowoomba Magistrates Court

Wanted on a warrant after fleeing from a roadside drug test, a Toowoomba man’s attempt at evading police through a Brisbane carpark ended in destroyed boom gates, tyre’s spiked and a jail sentence.

A brief pursuit through a Brisbane parking complex that saw boom gates destroyed and a car’s tyres spiked has landed a Toowoomba man behind bars for 50 days.

On February 5, 2022 about 11am, police stopped Dwayne Donald Hall for a random drug test on Hogg Street, Toowoomba Magistrates Court was told on Monday.

After providing a positive sample roadside, the 42-year-old was detained for a second sample, but while he was being walked back to his vehicle Hall fled on foot, prosecutor Senior Constable Chris Willson said.

Later that month on February 16, about 11.30pm, police saw the same vehicle in Herschel Street in Brisbane, and a check on the owner revealed that he was wanted by virtue of a warrant.

Senior Constable Willson said police attempted to intercept the vehicle as it was driving into a parking complex, but after police activated lights and sirens, Hall drove through the entry boom gate, destroying it.

A short time later, Hall exited the parking complex through a second boom gate, destroying it as well.

The court was told police used tyre spikes as the vehicle left the complex, and it was found a short distance away abandoned with no sign of Hall.

On June 17, 2022, police caught up with Hall when he was stopped about 4.30am on North Street at Mount Lofty after he was found driving without a licence.

On Monday, Hall pleaded guilty to evasion, obstruct police, wilful damage and driving without a licence.

Hall’s solicitor Kirsty Smith said her client had turned things around since February and had been working up until his arrest in June.

Ms Smith said her client had also mad admissions to the February offending after he was stopped by police, and that he had fled from police in Brisbane because he knew that he was wanted and feared going to jail.

Those fears became a reality when magistrate Kay Philipson sentenced Hall to 50 days jail, disqualified him from driving for two years, three months and ordered he pay $4000 restitution, referred to SPER, for the boom gate damage.
