Dodd then took off his shirt and advanced on Mr Piok with his fists, the court heard.

Mr Piok attempted to scurry away, however once he made it to his feet, he fell over a bench causing his phone to fall to the ground.

He again ran away and Dodd attempted to pursue him, but soon returned to the area to retrieve and smash the man’s phone.

Sergeant Wheaton said after Dodd made multiple attempts to smash the phone, it eventually split in two.

At the Toowoomba Magistrates Court on Wednesday, January 31, Dodd pleaded guilty to assault and wilful damage.

Solicitor Charmaine Malam said at the time Dodd was intoxicated and the 33-year-old man had since sought help to address his addiction issues.

The court heard Dodd had a “significant criminal history” however he was last before the court in 2019.

Dodd was ordered to complete 40 hours of community service and pay Mr Piok $770 in restitution for the damage caused to the phone.

He has three months to complete the unpaid community service order.
