A Dalby man accused of getting a woman in a headlock during an argument and twisting her neck to the point she couldn’t see properly denied that charge and claimed he acted in self defence.

Aaron Lee Lammonde was separated from the woman but had gone to the house to see his stepson, Toowoomba Magistrates Court heard.

While he accepted there was an altercation, the 32-year-old claimed he at all times had acted in self defence, his solicitor Nathan Bouchier told the court.

Mr Lammonde had some minor abrasions on his arms, he submitted.

Mr Bouchier applied for bail on behalf of Mr Lammonde who watched via video link from the Toowoomba watch house on Wednesday, January 3.

Mr Lammonde was not required to enter any pleas to charges of assault occasioning bodily harm and breaching a court order.

Police prosecutor Sergeant Derek Brady, appearing via video link from Dalby Police Station, said police objected to bail.

He said the alleged incident was played out in front of witnesses and children at the home.

Sgt Brady said he had checked the nominated bail address for Mr Lammonde which was suitable but Dalby was a smaller town than Toowoomba although it was conceded Mr Lammonde and the woman would be living in the same town but some distance apart.

Magistrate Kay Ryan said the charges were serious and it appeared the police case was strong given witness statements but Mr Lammonde was contesting the charges and that would have to be sorted out in court which would take time.

She noted Mr Lammonde had a suitable bail address and prospects of employment in Dalby.

Ms Ryan granted bail on condition Mr Lammonde live at the Dalby bail address provided to the court, report to police three times a week and have no contact or go to the address of the complainant woman.
