Two men charged with murder arising from the death of a man in Toowoomba in December 2021 may at last have their day in court.

Aaron John Leslie Bunt, 29, of North Toowoomba, and 32-year-old Oakey man William John Currey were each charged with murder after the death of 53-year-old Len Andrew Hegarty whose body was found inside a Ruthven St house in North Toowoomba on Christmas Eve 2021.

Police claim Mr Hegarty died of injuries sustained after being assaulted at the home he shared with Mr Bunt and Debbie Jane Richards, 33, who has also been charged in relation to the incident.

Ms Richards is charged with manslaughter on the grounds she had allegedly failed to obtain medical assistance for Mr Hegarty who police allege died in bed after he was assaulted.

At a mention of the case before Toowoomba Supreme Court on February 7, the prosecution submitted that all three accused should be tried at the same time.

However, the court was told Ms Richards’ case was delayed because Mr Bunt and Mr Currey had not as yet been afforded a pre-trial committal hearing which both were seeking.

Mr Bunt and Mr Currey’s respective cases were mentioned before Toowoomba Magistrates Court on Friday, February 16, and their potential committal hearings were mentioned.

Police prosecutor Sergeant Julia Wheaton said it appeared Mr Currey’s legal counsel sought seven witnesses for cross examination at that hearing while Mr Bunt’s lawyers were seeking to cross examine just one witness.

Magistrate Clare Kelly remanded both accused men in custody and adjourned their cases for mention back in the same court on April 12 when a date for committal hearing may be set.
