The case against a Toowoomba teenager charged with murder arising from the death of well-known 75-year-old photographer Robert Brown has been adjourned again.
Isaac Zane Cubby, 18, has been held in custody since his arrest on the charge of murder in February 2023 and was not required to be in Toowoomba Magistrates Court on Friday when his case was mentioned.
Mr Cubby is accused of running up behind Mr Brown who was waiting at a taxi rank on Margaret St outside Grand Central just after 5pm, February 6, 2023, and pushing the 75-year-old over before allegedly stealing Mr Brown’s backpack and running off to a waiting vehicle on nearby Dent St.
Mr Brown hit his head on the road when he fell and died in hospital a week later having never regained consciousness.
Mr Cubby has not yet been called upon to enter any pleas to his charges which include murder, robbery in company and unlawful use of a motor vehicle arising from the incident or to 16 unrelated charges which include burglary, armed robbery in company, dangerous operation of a motor vehicle and grievous bodily harm.
At the mention of his matters in court on Friday, Mr Cubby’s solicitor Phil Stainton of Legal Aid Queensland told the court that barrister Steve Kissick had been briefed in the matter but they were still awaiting outstanding material from the prosecution including the pathology report.
Without the pathology report, the defence could not decide on the next step to take in their client’s case, he said.
Police prosecutor Rowan Brewster-Webb told the court it was expected that by the next mention of the matter the prosecution would have an estimated time of arrival of that report.
Magistrate Mark Howden therefore remanded Mr Cubby in custody and adjourned the case for committal mention back in the same court on March 8.
