A man accused of public masturbation in a phone booth, then allegedly in a police watch house has been granted bail despite his history of wilful exposure.

Jamie Lee Brimble appeared in the Proserpine Magistrates Court requesting bail after being charged with wilfully doing an indecent act in public and wilfully doing an indecent act with intent to insult or offend a person.

The court heard on 25 May, Mr Brimble was allegedly caught masturbating in a public phone booth in Mount Julian.

The 37-year-old was then taken to the watch house where he allegedly began masturbating in front of a female constable.

The court heard the alleged offence was aggravated by the fact that he was on bail for an offence of a like nature at the time.

Magistrate Anna Smith said the alleged offence he was on bail for was even more serious given the age of the alleged complainant in that matter.

She also noted he was on probation at the time for different offending and had some history of willful exposure.

Solicitor Phillip Moore made a bail application on behalf of Mr Brimble.

He told the court Mr Brimble had been dealing with issues relating to his drug use and had only superficially engaged with support through his probation.

He said if Mr Brimble was granted bail he would be able to seek relevant counseling.

Magistrate Smith said the case against Mr Brimble was strong but given the maximum penalty for the charges was two years imprisonment, there was a gap in offending of a like nature between 2021 and 2025, and it was unlikely he would spend time in actual custody he was granted bail.

She said the risk of him committing further offences could be ameliorated to a satisfactory level.

She noted though that offences of a like nature would be “distressing for the public, particularly young people if they have to view that.”

Mr Brimble was granted bail with the conditions that he abided by a curfew, report weekly to Whitsunday Police Station, consume no drugs or alcohol, and participate in drug and alcohol counseling and mental health counseling.
