Wyatt Mooney, Bradley Sheather plead guilty to wilful damage at Sippy Downs

Two Sunshine Coast men have admitted to their involvement in a nasty incident during a neighbourhood dispute that erupted between two households over a shared driveway.

Two Sunshine Coast men must pay back hundreds of dollars after they damaged a car during a bizarre neighbourhood feud.

Maroochydore District Court heard last week a dispute between two households in Sippy Downs erupted into a standoff between multiple people, including Wyatt Mel Mooney of Mountain Creek and Bradley Charles Sheather of Nambour.

Judge Glen Cash said tensions were high on October 13, 2022 following arguments about people from the pair’s home blocking a shared driveway in the street.

The court was told there was a “set-to” between the complainant and some on Mooney and Sheather’s side.

During the wild fracas, crown prosecutor Rebecca Marks said Mooney damaged a letterbox, while a witness saw him also deliver 20 “fly kicks” to a vehicle.

The court heard Sheather, 25, “aided” the damage inflicted by others by kicking the vehicle once.

Ms Marks said the complainant was “surrounded” to some degree while Mooney behaved “quite aggressively” during the damage offending.

The total damage to the car was $2365.72, with the vehicle still not fixed.

Both men were charged with assault however this was discontinued, with Mooney pleading guilty to two counts of wilful damage and Sheather pleading guilty to one count.

Defence barrister David Crews, who acted for Mooney, said the Mountain Creek man previously worked as a painter but was not working at the moment. He also lived with his partner their two kids and was helping to build a home at Yandina.

Sheather’s barrister, Lachlan Ygoa-McKeown, said the Nambour man only kicked the vehicle once during the wild fracas but was liable as a party.

Mr Ygoa-McKeown said the 25-year-old grabbed the keys of the car during the incident to prevent, in his eyes, possible harm from the vehicle being used.

He said the plumber was “entirely shocked” and did not anticipate for the complainant to be allegedly assaulted during the incident. This was not elaborated on further during the sentencing hearing.

Judge Cash said the pair was involved in the overall event, however, they were not criminally liable for everything that happened.

He said Mooney was old enough to know better, and said to Sheather the events in the past two years would have caused him to “regret his involvement” in events.

Mooney was jailed for two months, suspended immediately for six months.

Sheather was released on a six-month good behaviour bond with no conviction recorded.

The Mountain Creek man must pay $800 compensation while the Nambour man was ordered to pay $500.
