A Sunshine Coast man has been handed more jail for his half-baked role in a home invasion that led to a man being bashed.
Nathan Trevor Head and his co-accused had their own grievances with the victim after they allegedly entered his Mooloolaba unit on October 27 last year and levelled a violent attack on the man.
The pair’s allegedly impulsive offending was heard in Maroochydore Magistrates Court on Wednesday after pleas of guilty to enter dwelling and commit, assault, breaching bail and failing to appear in court.
The court heard the man and his co-accused allegedly went to the victim’s home where they accused the man of slashing the co-accused tyre’s.
In reading the facts to the court, magistrate Rod Madsen said Head picked up a bottle and swung it at the victim before both men allegedly pushed the victim in the chest, forcing him to fall back.
Head, along with his co-accused, allegedly swung punches at the victim before pressure was applied to the victim’s throat as the hitting continued.
The men left but 10 days later Head antagonised the victim again as they lived in the same unit complex and assaulted him again.
The court heard Head breached his bail on January 27 this year by yelling threats at the victim before failing to appear in court on February 5.
He was taken into custody on March 25 and spent 51 days on remand before he appeared in court by video from jail for his sentence this week.
Police prosecutor Bec Lambert said Head, who had nine pages of criminal history, was not involved in the ongoing dispute but accompanied his co-accused for the home invasion as “retaliation” with the use of “implements”.
Sergeant Lambert labelled them “violent and thuggish” acts and said vigilante justice should not be tolerated.
Defence solicitor Mike Phillips agreed the Toowoomba-born man’s offending was “disproportionate and inappropriate” but claimed there was a history of ongoing disputes between the parties which was essentially a “ticking time bomb”.
The solicitor said the catalyst was the victim allegedly slashing the co-accused’s tyres.
Since the offences, Mr Phillips said Head was evicted from his housing complex.
Mr Phillip also claimed the victim had thrown a bottle at the 34-year-old after the pair was arguing, which led to the assault.
Mr Madsen took umbrage at defence submissions about the Mooloolaba man’s role in the home invasion and cited Head’s comments to police where he “minimised” his involvement.
“He wasn’t there to go and play tiddlywinks or marbles, he was there to help his (co-accused) right a wrong,” the magistrate said.
“[Head] clearly had it in for the victim.”
Head was jailed for two years and with 51 days already served, he set his parole release date to November 25.
