What happens when you are charged with a crime?

A Nambour mechanic took it upon himself to spit in the face of a teenager at the Peregian Beach IGA because he was angry the victim failed to wear a face mask.

Elijah Lloyd Charles Skiller, 32, was ordered to pay $750 compensation to the victim and sentenced to 12 months’ probation and 150 hours of community service in Maroochydore Magistrates Court on Tuesday.

The court was shown CCTV footage showing Skiller walking up and kicking the 18-year-old teen in the back of the leg at the supermarket on January 23.

The footage showed Skiller briefly speaking to the victim before he pulled his face mask down and spat in the teenager’s face.

Police prosecutor Mark Burrell said Skiller performed the “vile and disgusting” act on the teen because he failed to wear a mask during the Omicron peak at the start of 2022.

The court was told the spit could’ve led to Covid being transmitted.

Senior Constable Burrell said Skiller’s treatment of the person who was much younger was anti-social and the teen had to do a disease test as a result of the spitting.

Defence lawyer Ben Rynderman told the court Skiller had family who were immunocompromised and the incident had come from “uncontrolled anger”.

Mr Rynderman said the 32-year-old mechanic had engaged in rehabilitation for his rage issues even before he was charged by police.

Acting Magistrate John Milburn said Skiller’s act was “shameful” and “targeted”, all because he was critical of the teenager not wearing a mask.

Skiller pleaded guilty to two counts of common assault.

A conviction was recorded.
