A Nambour man who said he was “horny” after smoking a ‘marijuana cigarette’ decided to masturbate in a cubicle near a children’s playground for two hours. Read his punishment.

A Nambour man who masturbated for nearly two hours near children in Dick Caplick Park in Eumundi said he did it because he was “horny” after smoking a joint.

Desmond Gordon Warfe, 43, was fined heavily after he confessed to touching himself only hundreds of metres away from children and families in a Eumundi park on May 4, 2022.

Noosa Magistrates Court was told on May 31, 2022, a passer-by called police to reports a man had been acting indecently near the park’s public toilets along Memorial Dr about 3.30pm on May 4.

Police prosecutor Alison Johnstone said officers found Warfe at a nearby bus shelter who told them he had been masturbating for two hours after smoking a “marijuana cigarette”.

He told officers the joint had made him horny.

Warfe told police he had the cubicle door shut and each time someone would use the bathroom he would wait for the other person to flush before resuming.

The court heard he had been regularly masturbating in public and had been “doing it for years”.

Sergeant Johnstone said the cubicle was close to a playground where children and parents were at the time.

After he was transported to the station officers realised Warfe had something in his mouth and found he had tried to swallow some marijuana he had in his possession.

The court was told he tried to eat it to avoid being charged by police.

Defence solicitor Katie Paterson said the 43-year-old father and former Woolworths worker had no idea his two-hour self love session was illegal as he had seen it done in movies.

Ms Paterson said he had lost his job during Covid and had become transient.

Warfe pleaded guilty to possessing drugs and to an indecent act in public and was fined $750 with a conviction recorded.
