A Noosaville man allegedly hurled racist remarks at a cop before allegedly committing a disgusting act that had him hauled before court.

A Noosaville man has been refused bail for allegedly using racist remarks towards police before spitting at an officer.
Police allege Benjamin Tynan Drake-Brockman committed the assault on the officer on January 21 at The Esplanade in Maroochydore, which resulted in him being charged with seriously assaulting police and public nuisance.
The 39-year-old applied for bail in Maroochydore Magistrates Court last week, where the court heard there were multiple witnesses who saw the alleged spit attack. There was also body worn camera footage.
Police prosecutor Val Crossley alleged the unemployed man had some alcohol issues and claimed it was a strong case.
Senior Sergeant Crossley said the police officer needed a disease test.
Drake-Brockman interrupted the prosecutor during her submissions, at one point saying “bulls--t” when the she alleged the spit landed on the officer’s vest.
This prompted magistrate Rod Madsen to intervene, who warned he would remand the Noosaville man in custody for a day.
“That was completely inappropriate,” Mr Madsen said.
Duty lawyer Liesel Rogan said Drake-Brockman understood the severity of his comments and asked for the bail application to continue.
Senior Sergeant Crossley said there were four instances of failing to appear in court on his criminal history along with other similar offences of public nuisance and assault police.
She said the 39-year-old was not in danger of serving more time if remanded in custody.
Ms Rogan said she would use “different vernacular” to that of Drake-Brockman, indicating he would not contest the public nuisance charge but wanted to see body worn camera footage for the alleged spit attack.
The duty solicitor said he would comply with strict bail conditions if released on conditional liberty and was instructed he had not been medicating his mental health conditions recently.
Mr Madsen read some of Drake-Brockman’s allegations to the court, which involved “actual violence” towards a First Nations person where they suffered injuries. Police also allege the 39-year-old made “insulting, racist” comments directed at officers.
Drake-Brockman was refused bail and his matters were adjourned February 24.
