A veteran seaman has received no conviction after he attacked an older man over an argument about “alleged queue cutting” at Bunnings Warehouse in Maroochydore.
Adam Anthony Doolan, who served his country in the navy overseas from 2008-15, pleaded guilty to the charge of serious assault of a person over 60 on Wednesday following the violent incident at the hardware shop on July 1 last year.
Police prosecutor Val Crossley said the victim and the Maroochydore man were in the line at Bunnings when an argument started between the pair.
Senior Sergeant Crossley said Doolan then pushed the older man in the chest which caused the victim to fall and hit his head on the concrete. He also injured his elbow.
Maroochydore Magistrates Court heard how the victim was confused and suffered immediate pain. He was later taken to hospital and treated for a concussion.
The police prosecutor said it was an unprovoked attack as the pair was not known to each other.
Defence lawyer Michael Robinson said the 43-year-old man was a navy veteran of several years and was medically discharged.
He said Doolan suffered mental health conditions including post traumatic stress disorder and was now on a lifetime defence force pension.
Mr Robinson said he was instructed Doolan was at Bunnings to get a key cut and was in a separate queue when an argument began over “alleged queue cutting”.
The Legal Aid solicitor said CCTV footage showed both men advance towards each other, where Doolan believed he may have been touched initially.
His lawyer said the 43-year-old -year-old was immediately remorseful and provided his details to staff.
Magistrate Rod Madsen accepted Doolan was immediately sorry and acknowledged he was in the wrong.
He placed Doolan on a 12-month probation order with no conviction recorded.
