A magistrate spoke of a man’s alleged bikie gang association in court as charges were mentioned for three men who allegedly rammed another person off the road and bashed him.
Nicholas William Pozzebon, Nathan Peter John Dyson and Matthew James McKenzie had their matters mentioned in the Maroochydore Magistrates Court on Friday.
Their charges relate to an incident where the victim was allegedly followed in his car for 25km and then rammed before he was given a fractured eye socket, nose and wrist in an alleged group bashing.
Court documents previously seen by this publication allege Mr McKenzie was an “associate” of the Rebels while Mr Pozzebon and Mr Dyson were “patched” members.
Defence lawyer and town agent Eric Halden told the court Mr Pozzebon remains in custody and it was believed a brief of evidence was nearly ready.
Four charges stemming from the incident were adjourned to February 10.
Mr Halden said the remaining charge of wearing a prohibited item, a vest, was unrelated to the incident and would be contested.
Magistrate Haydn Stjernqvist adjourned it to the same date.
Mr Stjernqvist asked Mr Halden if “it’s a bikie”, referring to Mr Pozzebon, to which the lawyer confirmed.
Mr Dyson, represented by law clerk Ethan Lloyd as town agent, was also on remand in custody, the court was told.
Police prosecutor Nick Nitschke said three briefs of evidence were ready at his office and simply needed to be disclosed.
Defence lawyer Chris Lumme told the court his firm was also awaiting the brief for their client, Mr McKenzie.
Mr McKenzie’s and Mr Dyson’s matters were also set for February 10.
Court documents this publication previously viewed stated Mr McKenzie splashed $50,000 into an investment business with the alleged victim, but Mackenzie wished to remove the investment, eventually receiving $58,000 from the victim.
Documents stated the man allegedly received a message from Mr McKenzie with words stating similar to “if money wasn’t returned all bets were off”, later followed by a video of the victim himself leaving a gym.
At the sight of this, the alleged victim changed his routine due to McKenzie’s alleged affiliations with the Rebels bikie gang.
Police previously alleged on September 18, the man left a gym in Warana in his Mercedes Benz when he believed he was being followed by a Ford Ranger driven by Mr Dyson.
The alleged victim continued to drive until he was travelling south on the Bruce Hwy when he saw a Dodge Ram 1500, allegedly driven by Mr Pozzebon with Mr McKenzie in the passenger seat, join the Ford Ranger.
Police alleged Mr Pozzebon’s car rammed the alleged victim’s vehicle, causing him to lose control, before leaving the highway heading to Palmview, with the two cars driving after him.
Documents state the Ram then collided with the rear of the man’s car, causing both vehicles to crash through temporary fencing and over an embankment into a field.
Mr Dyson has been charged with contravening an order about accessing an electronic, endangering the safety of a person in a vehicle, grievous bodily harm (organised crime), operating a vehicle dangerously by speeding and having drug present in his system while driving.
Mr McKenzie has been charged with grievous bodily harm (organised crime), operating a vehicle dangerously by speeding and endangering the safety of a person in a vehicle.
Mr Pozzebon has been charged with the same offences as Mr McKenzie alongside a charge of having drug present in his system while driving and wearing a prohibited item in public.
