A man with neurofibromatosis and a two-page criminal record who was living at a motel in Central Queensland became frustrated at the manager and started causing damage with an axe.

A man with neurofibromatosis and a two-page criminal record who was living at a motel in North Rockhampton became frustrated at the manager and started causing damage with an axe.

The Rockhampton Magistrates Court heard an argument ensued between Samuel Jacob Bryon Stubbs, 23, and staff at Parkhurst Motel and Van Park and that police responded on October 30 at 11.10am.

Police prosecutor Corey O’Connor said Stubbs had damaged a wall inside the room he was living.

“There was a fist sized hole in the wall of the unit,” he said.

Mr O’Connor said there was a larger hole in the same wall and that a glass louvre window had also been damaged.

He said Stubbs was captured on CCTV on October 30 damaging a chair outside his unit with an axe.

Defence lawyer Stephanie Nicholas said her client explained “he became very frustrated when the owner/manager of the motel had been, what he says, provoking him by purposefully connecting to his Bluetooth on the PlayStation”.

“That has affected his ability to use it and he feels like the owner may have been trying to hack his bank accounts,” she said.

“That is what he said was happening.”

Ms Nicholas said her client had ADHD, Asperger syndrome and neurofibromatosis, a condition that causes tumours to form in the brain, spinal cord and nerves.

“He has benign tumours in his body,” she said.

“He has only 20 per cent hearing in his right ear, eye issues and it causes seizures.”

Stubbs pleaded guilty to one count of wilful damage.

He was ordered to 12 months probation with a criminal conviction recorded.
