A woman who caught a convicted drug trafficker attempting to break into her home fought the man off with a mop handle only to later wake and find the meth-using dad standing inside her kitchen.

A woman who caught a convicted drug trafficker attempting to break into her home fought the man off with a mop handle only to later wake and find the meth-using dad standing inside her kitchen.

Rockhampton Magistrates Court heard the woman saw Jase Colin Smith, 29, peering through the top of the window frame in the kitchen area about 5am on January 3.

Police prosecutor Sergeant Darrell Dalton said the woman told Smith to leave and hit him with a mop handle as he tried to come through a window.

Sergeant Dalton said the woman went to sleep and that Smith gained entry to the home.

Smith was found inside the kitchen.

The court heard Smith was outside the home again on January 19 when this time he spat at the mother of his child through a screen.

“That’s a disgusting thing,” magistrate Grace Kahlert said.

“Fortunately the flyscreen seemed to have stopped the spit hitting her.”

Sergeant Dalton said Smith was on parole at the time he committed the offences after being sentenced to three years prison in the Supreme Court in Rockhampton on August 26, 2021 for trafficking methamphetamine and marijuana, three counts of possessing dangerous drugs, and one count each of possessing utensils or pipes that had been used and possessing anything used in the commission of a crime defined in part 2.

Smith pleaded to those offences and was released on parole on November 25, 2021.

Defence lawyer Samantha Legrady said drugs were an issue for her client, who hailed from Biloela and started smoking marijuana from the age of about 12 or 13 and using meth from 19 following the breakdown of a four-year long relationship.

“After the relationship breakdown his life spiralled out of control,” she said.

“He did manage to become clean and free from drugs for three to four years but then when his nan passed away he made some foolish choices and got back into the drug scene.”

Ms Legrady said her client was under the influence of meth when he committed the offences before the court and “didn’t remember a lot of what occurred at the time”.

“He was a heavy user, using three to seven points a day,” she said.

Smith pleaded guilty to one count of enter dwelling with intent to commit an indictable offence and common assault.

Ms Kahlert sentenced Smith to 12 months prison with immediate parole eligibility.
