A Central Queensland mine worker who accused his partner of sleeping with his work mates before threatening to cut her head off, has faced court.
Daniel Victor Brady, 44, pleaded guilty in Biloela Magistrates Court on October 26 to assault and contravening a domestic violence order.
The court heard Brady’s offending happened on September 8 at Valentine Plains.
Police Prosecutor Sergeant Carl Spargo said throughout that day, Brady accused his partner of sleeping with his work mates.
Sgt Spargo said Brady then called a child who was present “a f---ing little c---” and he called his partner “a hoe and a s--t.”
The prosecutor said Brady tried to pull his partner down the stairs.
“(Brady) then grabbed a large butcher’s knife and threatened to cut (his partner’s) head off,” Sgt Spargo said.
The woman called police.
Sgt Spargo said while being questioned by police, Brady said: “Na she’s not dead yet” and “I didn’t cut her throat.”
Sgt Spargo said there were “relevant” entries on Brady’s criminal history which included common assault.
The court heard that Brady was on a suspended sentence for common assault at the time of committing these offences.
Solicitor Richard Parks said Brady was a multi-skilled operator training assessor at Callide Mine where he had worked for three years.
Mr Parks said Brady admitted to having a “serious drinking problem” and attempts had been made to engage with Drug ARM (support for substance abuse and addiction).
Mr Parks said on the day of the offending there had been agitation “all day long” between Brady and his partner and his client was “extremely remorseful” for what he had done.
Brady’s matters were adjourned part-heard and when they resumed in the same court on November 9, Magistrate Philippa Beckinsale handed down sentence.
But first, she gave Brady some advice.
“What’s glaring - drinking. You’ve just got to stop,” Ms Beckinsale said.
“You look sober today - you’re acting sober. I’ve seen you in court when you’re not, so it seems that things have improved.”
Ms Beckinsale sentenced Brady to 12 months’ jail for the assault offence, six months’ jail for contravening a domestic violence order, and she activated the suspended sentence.
Ms Beckinsale released Brady on immediate parole and convictions were recorded.
