Two teenagers ganged up on a man and kicked him while he was on the ground in front of police after they were all removed from a Central Queensland nightclub for an altercation.
Dallas Jackson Dereck Hornung, 19, and Jacob Adam Spratley, 18, pleaded guilty in Rockhampton Magistrates Court on September 26 to one count of committing public nuisance.
Police prosecutor Sergeant David Longhurst said police were speaking with a man outside The Goat just after midnight on September 10 when he became involved in a physical altercation with Hornung and Spratley.
Sgt Longhurst said Hornung punched the man in the face and he fell to the ground.
He said Hornung and Spratley stood over the man and kicked him while he was on the ground.
He said Spratley struck a police officer in the elbow and the pair left.
He said there was no assault charge before the court.
Hornung’s solicitor, Ashley Reynolds, said her client had been out celebrating his partner’s father’s birthday and was drinking with friends inside The Goat when an altercation occurred between Spratley and the victim.
“As a result of that altercation all parties were asked to leave,” she said.
“They were outside The Goat and police were speaking to the victim.
“Matters became heated between the co-offender and the victim and a fight has broken out.”
Ms Reynolds said since the incident her client had stayed away from going out to the clubs.
Hornung was fined $800 with no criminal conviction recorded.
Spratley, who had no criminal history, was fined $400 with no criminal conviction recorded.
