Carter Giles sentenced for drunken incident at Pacific Hotel, Yeppoon

A man who suffered facial injuries after falling on concrete at a Central Queensland hotel then “spat blood” during an ugly confrontation with the venue’s duty manager, a court has heard.

A man who caused thousands of dollars damage in a drunken incident at a Central Queensland hotel, also “spat blood” during a confrontation with the venue’s duty manager, a court has heard.

Carter Giles, 24, pleaded guilty in Yeppoon Magistrates Court on May 9 to trespass, wilful damage and public nuisance within licensed premises.

The court heard that last November, Giles was banned from attending Yeppoon licensed premises including the Pacific Hotel for five years due to “ongoing disorderly and inappropriate behaviour”.

Police prosecutor Corey O’Connor said about 4am on April 13, Giles entered the Pacific Hotel through the front door and went straight to a smoker’s area where he stayed for about 15 minutes.

Mr O’Connor said Giles then climbed a fence to an adjoining property when the hotel duty manager came out to speak to him.

“The duty manager told (Giles) he was not to climb back over to the hotel and to find his own way out,” the prosecutor said.

The court heard that Giles made multiple attempts “to climb out” before climbing up a fibro wall fence between the two properties.

“The fibro wall gave way, (Giles) fell onto the concrete back into the hotel in the smoking area,” Mr O’Connor said.

“(Giles) managed to knock himself out for a short time before getting up, accepting assistance from witnesses.”

Giles had facial injuries from the fall including cuts to his forehead, a busted lip and his mouth was bleeding, the court heard.

Mr O’Connor said the duty manager approached Giles and attempted to assist with first aid and called Queensland Ambulance Service.

“(Giles) became abusive towards the duty manager, spitting blood in his face and pushing him.”

The court heard that Giles started yelling and swearing and witnesses tried to calm him down.

Giles left the hotel and police spoke to him on James St where they saw his injuries and that he was intoxicated.

Giles was taken to Capricorn Coast Hospital at Yeppoon.

The prosecution sought $2250 restitution for the damage to the fence and the court heard that Giles had no criminal history.

Solicitor Oscar Millroy said Giles was a roofer and on the night of the incident he had been having birthday drinks with friends and was “grossly intoxicated”.

Mr Millroy said Giles suffered “some very serious injuries” from the fall and “it wasn’t necessarily a direct spit” at the duty manager.

Magistrate Philippa Beckinsale fined Giles $400 and ordered he pay $2250 restitution.

No conviction was recorded.
