Blayke Smith sentenced in court for assault occasioning bodily harm

A security guard was in “immense pain” after he was “sack wacked” by a patron that he had asked to leave a pub in Yeppoon.

Blayke Andrew Raymond Smith, 26, pleaded guilty in Rockhampton Magistrates Court on February 14 to one count each of assault occasioning bodily harm and contravening a requirement of police.

Police prosecutor Clancy Fox said a security guard asked Smith to leave the Railway Hotel in Yeppoon on August 6, 2021 and as he walked past the security guard on his way to the exit he punched him in his genitalia.

Mr Fox said the strike caused the security guard to “double over” in “immense pain”.

He said police spoke to Smith on August 27 and that he told them he was a regular at the venue and that he gave the security guard a “sack wack” because he was drunk and “doing silly things in a friendly joking manner”.

Mr Fox said there was no significant or ongoing injury to the victim.

“It was very painful for the victim and also embarrassing for the victim to be struck in such an intimate place,” he said.

Mr Fox said Smith had failed to provide his identifying particulars to police between August 27 and September 4.

Defence lawyer Brandon Selic said his client had minimal violent offending on his criminal history, which he said spanned just over one page.

Smith was sentenced to prison for six months, suspended for 12 months, fined $250 and ordered to perform 40 hours of community service.
