Adam Paul Lumley Mcgough sentenced in Rockhampton court for assault

An award-winning ex-personal trainer brutally lashed out at his terrified girlfriend as she tried desperately to help him during a suspected drug overdose, fracturing her collarbone.

A former personal trainer, who has been banned from multiple venues on the Capricorn Coast, fractured a woman’s collarbone he was in a toxic relationship with after she tried to help him during a suspected drug overdose.

Adam Paul Lumley Mcgough, 38, has faced Rockhampton Magistrates Court after committing two strings of offending.

Police prosecutor Courtney Brown said the woman suffered a fractured collarbone after she was pushed by Mcgough in retaliation to her hitting him in the chest to raise him following advice by Triple-0 call taker during a suspected drug overdose.
Ms Brown said Mcgough also punched the woman in her nose and bent back one of her fingers after she threw his phone out of a vehicle.

She said Mcgough’s offending also included him making an “absolute nuisance of himself” at Railway Hotel Yeppoon on May 28 and assaulting police when they responded.

The court heard Mcgough also committed a public nuisance offence at The Strand Hotel in Yeppoon on June 8.

Ms Brown made a submission to ban him for 12 months from licensed premises in Yeppoon.

Defence lawyer Samantha Legrady said her client, who had a daughter and grew up in the Brisbane area, had completed a Certificate III and IV in Fitness and was a qualified personal trainer.

Ms Legrady said her client worked as a head personal trainer for a gym in Cleveland for a year, being awarded top personal trainer Australia-wide for two months running.

However, she said her client had to stop working after he suffered a work injury.

“Then unfortunately he consumed alcohol heavily,” Ms Legrady said.

Ms Legrady said. said her client did not wish to make any excuses for his behaviour and he was extremely sorry.

“He was highly intoxicated at the time,” she said.

“A lot of that period of time was a blur.

“He instructs the relationship was quite toxic.”

Mr Mcgough plans to move to Brisbane where he has the support of his parents, Ms Legrady said.

“His plan is to get himself back on track and also attend his GP,” she said.

She said her client suffered from depression and anxiety and planned to make sure his mental health was assessed properly and that he took the medication and “only what is required and stay away from illegal and illicit substances”.

“Mr Mcgough wants to focus on rehabilitation,” she said.

Mcgough pleaded guilty on Monday to three counts of committing public nuisance, two counts each of assaulting a police officer, wilful damage and assault occasioning bodily harm, and one count each of obstructing a police officer, threatening violence and common assault.

He was sentenced to 18 months prison with 80 days of presentence custody declared as time served and parole release ordered for October 21.

Convictions were recorded.

Mcgough was also prohibited from entering or remaining, or attempting to enter or remain, in all licensed premises located in Yeppoon, Emu Park and Keppel Sands for 12 months.
