A Queensland man called his ex hundreds of times and was later found with secret nudes in a four month stalking spree that continued in the face of multiple arrests and a domestic violence protection order.
On Tuesday, Mackay District Court heard the 35-year-old truck driver drove past the woman’s home, and went to her workplace to ask if she was sleeping with other people before leaving a ring in a love letter at the front desk.
The harassing behaviour peaked between July 5 and 7 in 2023 when he called his ex 305 times, 425 times, and a whopping 774 times respectively, the court heard.
Including other days the man spammed his ex’s phone, there were an estimated 1623 calls referenced in his sentence.
Judge Gregory Lynham shared the woman’s statement said she was left “traumatised” and living “the life of a recluse” in fear of the man’s “devastating” behaviour.
“I don’t have a psychological report (but) it’s obvious to me you have an obsessive personality trait that seems to make you act in this way,” Judge Lynham said.
“Your offending is serious.
“Not only did it involve obsessive, persistent, and protracted contact, (but it) occurred against the background of a domestic violence order and after being granted bail on three separate occasions following which you continued to offend.”
The court heard after being granted bail for his third arrest on July 25, the man called the woman 36 times that same day.
Crown prosecutor Shannon Sutherland said the man had a history of breaching DV protection orders and had faced court in Rockhampton for unlawfully contacting two other women.
Ms Sutherland said the man’s stalking continued from April 2023 until his arrest on August 22, when “concerningly” police found the naked pictures upon a search of his phone.
The man plead guilty to breaching DV protection orders, stalking (DV), taking photos in breach of privacy (DV), and two breaches of bail conditions.
Defence barrister Scott Moon said the man had suffered fines for his previous offending, so the 178 days in pre-sentence custody was his “first bout” in jail and the experience had left a “grave effect on him”.
“It’s sent him a very strong message of deterrence (and) he does not want any further contact the complainant at all,” Mr Moon said, adding the man had pleaded guilty at first opportunity.
Mr Moon said a punishment of 13 to 18 months incarceration would be appropriate, while Ms Sutherland submitted the man should serve 18 months to three years jailtime.
Judge Lynham sentenced the truck driver to a head sentence of two years, declaring the 178 days time served and releasing him immediately on strict parole conditions.
A restraining order was also put in place and Judge Lynham warned the man any parole breaches would have him “taken straight back into custody”.
Convictions were recorded.
