Jake William Gill faces Mackay court for assaulting father

A North Queensland man carried out a prolonged and violent assault on his own father, punching and biting the older man and threatening to kick him in the head.

A man has violently assaulted his father in an attack that included following him to the toilet to ask, “How would it make you feel if I kicked you in the head?”

Jake William Gill faced Mackay Magistrates Court via livestream from Capricornia Correctional Centre on Friday as his father and uncle watched on in support.

Magistrate Damian Dwyer said on November 6, Gill’s father was sleeping on the lounge room floor in his Bea home when Gill emerged from his bedroom.

“You yelled out, ‘You’ve ‘had five hours sleep in the last 48 hours, you f--king idiot, what are you doing waking me up? What are you doing making so much noise?’” Mr Dwyer told him.

The court heard the 23-year-old then chased his father around the house saying he “had been poorly brought up” and his dad “was a failure”.

Gill then stomped on his father’s left foot causing him to think his toes had broken, and punched his head numerous times including a “roundhouse style” punch to the side after his dad tried getting away.

The victim then sought refuge in the toilet but Gill approached him and said, “How would it make you feel if I kicked you in the head?”.

He then bit his father’s head.

It was at this point the older man fought back, punching his son once and knocking him to the floor, before fleeing to his brother’s house.

Lawyer Steven Hayles, of Macrossan and Amiet, said Gill suffered with mental illness that worsened when he stopped taking prescription medication and took up using methamphetamines.

“Despite the episode of what occurred, he still has his father’s support and has the support of his uncle and they will endeavour to help guide him back on the right path,” Mr Hayles said.

Mr Dwyer said he factored in Gill’s young age when sentencing him following pleas of guilty to contravening a domestic violence order and seriously assaulting a person over 60 domestic violence offence.

He told Gill he was “not a man of good character” with a five-year history of offending, which included a two-year jail sentence on February 24, 2022.

“(It) was an unprovoked, unwarranted, gratuitous, and prolonged attack on your father, and as such in my view, it involves a significant period of imprisonment,” Mr Dwyer said.

Gill was sentenced to 22 months in jail, with a parole eligibility date set for November 6, 2023.

“That means you have about 32 months to go (in jail),” Mr Dwyer said.
