A Mackay miner has created a ruckus at a Brisbane shopping centre after he made sexual remarks and threatened to assault staff.

Prosecutor Leonie Taufa’ao said David John Bane was asked to leave North Lakes Tavern at Westfield Shopping Centre on the evening of December 3 as he was fighting with other patrons.

“He was refusing to leave and was threatening to punch staff,” Ms Taufa’ao said before Mackay Magistrates Court on Monday.

The court heard Bane was evicted and then changed his clothes before entering Guzman Y Gomez where he made sexual and racial remarks at staff, with witnesses calling security to have him removed.

“(Bane) left for a short time then returned to the restaurant to complain that his (chicken) was cooked incorrectly,” Ms Taufa’ao said.

Bane continued to make a scene outside the restaurant and police were called to the scene.

Lawyer Rob Beamish, of McKays Solicitors, said Bane was born in Mackay and worked at Woolworths after leaving school in Year 11 before becoming a mine operator in 2009.

Mr Beamish said Bane was currently on a return to work program and making monthly visits to his doctor after a workplace incident on March 17, 2022 left him with post-traumatic stress disorder.

He said the 44 year old took “full responsibility” for his actions which included “sexual(ly)” winking at a female staffer and telling her she looked like Shania Twain.

Magistrate Damian Dwyer said he could tell Bane was “not a bad fellow” and was “just doing it a bit tough” with his criminal history, which included driving under the influence, starting after the workplace incident.

Mr Dwyer recommended Bane “get off the grog”.

Pleading guilty to public nuisance, Bane was fined $500. A conviction was not recorded.
