An Ipswich man has faced court for breaking into his former partner’s home and bashing her with a baseball bat – all because she rejected him.
Brassall’s Matthew David Daly, 39, pleaded guilty on February 14 to assault occasioning bodily harm (DV) and enter dwelling with intent by break (DV).
The Ipswich District Court heard Daly argued with his ex-partner on October 15, 2022 after she told him she did not want to resume a relationship with him.
He later returned to her home to collect some of his belongings, but she refused to let him inside.
Judge Katherine McGinness said Daly then forced his way inside, took out a pocket knife and threatened to stab the woman.
She said the woman defended herself with a spray can and lighter when Daly came towards her.
Daly then hit her on the arm with a baseball bat, causing bruising and swelling.
Judge McGinness said he then squeezed her into a bear hug before she managed to flee.
Daly was arrested the same day and remanded in custody until his sentence.
Only 222 days of that period could be declared as time served because he was on parole at the time of the offending.
The remaining portion of the time he spent in custody was instead counted towards his previous sentence.
Judge McGinness said Daly had a relevant criminal history, including a dated conviction for assault occasioning bodily harm and numerous drug and dishonesty offences.
She said he had struggled with a longterm drug addiction as well as anger in domestic relationships.
The court heard Daly had been working on his substance abuse issues while in custody.
He was on a disability pension due to a serious back injury he sustained some years ago.
Judge McGinness said she would moderate the head sentence she imposed to account for the significant period of time Daly had spent in custody.
She sentenced him to two years and nine months’ jail, with immediate parole eligibility.
His 222 days of presentence custody were declared time served.
