A Mary Valley teenager has been banned from Gympie region pubs after he and his father ganged up to bash another person at the Jockey Club.

Gympie Magistrates Court heard Cody James Kelly, 19, of Kandanga, his father, and two friends had tried to enter the club shortly after midnight on June 4.

The group was asked to leave due to their behavior at the Phoenix Hotel earlier in the night and Kelly’s father started arguing the point with the hotel staff.

The argument escalated when the father turned violent against the staff member, another person tried to intervene and a fight broke out.

The police prosecutor told the court Kelly’s father started punching the man in the head; Kelly then grabbed the man in a headlock so his father could continue punching him, while other people were pushed into tables.

Jockey Club staff refused Kelly’s group entry following their behaviour at the Phoenix Hotel earlier in the night.

The fight was captured on CCTV; offices found the Jockey Club’s furniture overturned when they arrived.

Kelly, a FIFO worker employed at northern Queensland’s mines and who represented himself in court, said there was “not much to say” in his defence.

Magistrate Chris Callaghan told Kelly the “events of the night paint a bad picture of poor behaviour”.

He criticised the 19-year-old’s choice of ganging up on another person, saying “two on one is never acceptable”, fined him $800 and ordered no conviction be recorded.

Mr Callaghan also banned him from drinking at any licensed premises within the 4570 postcode, which stretches from the edge of the Toolara Forest, out near Tiaro and Kilkivan and down to Kenilworth. It covers almost 4000 square kilometres.

The ban will last for one year.

The court was not told whether Kelly’s father has been charged over the incident.
