The sentencing of a teenage boy responsible for causing a crash that claimed the lives of three women in Maryborough looks set to go ahead on Monday after his legal representatives suddenly withdrew earlier this week.
The boy, 14, who cannot be named for legal reasons, was 13 when he caused the crash while driving a stolen Mercedes on Saltwater Creek Rd on April 30, 2023.
The impact forced the sedan into the path of nurse Sheree Robertson, 52, who was driving back to Hervey Bay after working a shift at Maryborough Hospital.
She died at the scene.
Occupational therapist and church pastor Michale Chandler, 29 and dancer Kelsie Davies, 17, who were in a Holden sedan, were also killed.
The crash also left Kaylah Behrens with serious injuries.
The boy pleaded guilty to dangerous operation of a vehicle causing death and grievous bodily harm, and will be sentenced in Hervey Bay.
On Wednesday, the court heard from Crown prosecutor Chris Cook and defence barrister Ed Whitten addressed the court in relation to the status of the matter.
Mr Whitten said at this stage he did not anticipate there would be an application for an adjournment.
He said the boy would be transferred to the watch house in Hervey Bay ahead of sentencing and he anticipated he would spend some time on the weekend conferencing with the young defendant.
“He understands that means a weekend in the watchhouse for him, but he’s very eager to have some finality to all of this,” Mr Whitten said.
The child was expected to appear before the court for a brief mention on Friday, the court heard.
During Wednesday’s mention, Judge Gary Long also ordered that undisclosed parts of a pre-sentence reports regarding the teen be made available to the Crown.
It comes after lawyer Travis George sought leave to withdraw from the matter on Monday.
“Conflicting instructions have arisen from the young person,” he said.
Mr George said the conflict had arisen about a week ago and his firm was not in a position to be able to represent the teenager.
“One assumes, Mr George, that this has all very carefully been thought through,” Judge Long said.
“Yes,” Mr George said, adding that it was a “very serious matter”.
Mr George said the grant of legal aid for the matter had been transferred to another firm.
Judge Long gave Mr George leave to withdraw.
New representative Virginia Ukpabi from Geldard Sherrington lawyers addressed the court on Monday in relation to the matter, asking for an adjournment until Wednesday to provide an update on whether the sentencing would be able to proceed on Monday.
The court heard the boy remained in Brisbane Detention Centre awaiting sentencing.
There had been some suggestion restorative justice could be carried out between the teen and the next of kin of the deceased women, the court heard, but the teenager had ultimately decided not to take part in the process.
Crown prosecutor Ashleigh Worthington also raised the issue of an undisclosed psychological report during the mention.
