The court heard on April 13, 2024, the woman was travelling along Booral Rd at Sunshine Acres with her four children, when she overtook a white Toyota HiLux.

The occupants of the HiLux started berating her about her overtaking action, the court heard.

The victim took a photo of Brady, who was the passenger in the vehicle.

He then through a drink through the window of the vehicle, hitting the woman in the face and causing a red mark to her right cheek just under her eye.

The cup then ricocheted off the woman and hit her eight-year-old daughter, the court heard.

The contents of the cup spilt through the vehicle, going all over the interior panel seats, the floor and the woman and her daughter.

The Toyota then performed a U-turn and drove past the victim again, with one of the occupants yelling out, “I know where you live now c —t”.

The court heard it was the first time Brady had appeared before a court.

He had been a passenger in the vehicle that day, and it was the driver who had followed the woman, the court heard.

They claimed the woman had illegally overtaken them and they wanted to “just have a discussion” with her.

But it had turned into a heated verbal argument and he threw the cup “in frustration”, the court heard.

It heard it had not been a prolonged assault but had happened in the head of the moment and he was remorseful.

Brady was the father of a six-month-old child and was currently unemployed but had previously worked in farming, the court heard.

His partner was present and supporting him in court.

Magistrate John Milburn said Brady was youthful and had no criminal history.

He said Brady had acted in a way that was disrespectful and had caused harm.

Brady was fined $600 and no conviction was recorded.
