Todd Gary Ashwood charged with attempted murder over Maryborough shooting

The man who allegedly shot Maryborough man Daniel Baumgart has had his case mentioned in the local magistrates court.

The man who allegedly shot Maryborough man Daniel Baumgart has had his case mentioned in the local Magistrates Court on Monday morning.

Todd Gary Ashwood, 45, was arrested on Saturday January 18 and charged with one count of attempted murder after an alleged altercation with Mr Baumgart on January 13.

Mr Ashwood’s appearance was excused by Magistrate John Milburn.

Geldard-Sherrington Lawyers’ Virginia Ukpabi, who appeared via telephone, was chosen to represent Ashwood after a conflict arose with the court’s duty lawyer, Morgan Harris of Suthers George Lawyers.

Ms Ukpabi made no application for bail and sought an adjournment of four weeks to acquire and review the brief of evidence.

Mr Ashwood’s case has been adjourned to March 24 for a committal mention at the Maryborough Magistrates Court.

He was remanded in custody and will appear via video during his committal.

Meanwhile, a 52-year-old man linked with the shooting and charged with multiple offences including one count each of unlawful possession of weapons, stealing, obstructing police and receiving tainted property firearm/ammunition, as well as two counts of possessing dangerous drugs also had his case mentioned before the Magistrates Court.

Andrew Thomas Wells also did not appear in front of Magistrate Milburn and made no application for bail.

Following Wells’s arrest, police executed a search warrant at a business on Adelaide Street where a 3D printed gun, ammunition, and a quantity of methamphetamines was allegedly located.

Police Prosecutor Lennon Stathoulis said there may be case conferencing regarding Mr Wells’ weapons offences.

The matter was adjourned to March 11, 2025, where Wells will appear via video link.

Earlier, police alleged a 45-year-old man produced and discharged a firearm at Mr Baumgart before fleeing the scene on an e-scooter.

Mr Baumgart was taken to hospital with a life-threatening injury to the head.

On Saturday, January 18, police said the 45-year-old man was found riding an electric scooter on Churchill Street, where he was taken into custody and taken to Maryborough Watchhouse.

Mr Baumgart is understood to be missing part of an ear and has significant injuries to the back of his skull.

It comes after he survived a near-fatal stroke early last year.
