Maryborough’s David James Marshall jailed for assault

A Maryborough dad will spend Christmas away from his one-year-old child and pregnant partner after he punched another man in the face at a supermarket.

David James Marshall, 41, pleaded guilty to common assault when he faced Maryborough Magistrates Court on Tuesday.

The court heard Marshall entered the IGA at Gayndah on August 2, and exchanged words with another man before hitting him in the face.

Marshall had reacted after the man sent threatening and harassing messages to Marshall’s partner, it heard.

He was on parole at the time of committing the offence, the court was told.

When Marshall was spoken to by police, he admitted what he had done.

Marshall had an extensive criminal history which included violent offences for which he had previously served time in prison, the court heard.

He had been struggling after losing his father, defence lawyer Morgan Harris said.

Magistrate Kurt Fowler said he understood there was history between Marshall and the victim, but was concerned by his criminal history.

“Your history is problematic,” he said.

Marshall was sentenced to four months in prison, suspended after two months with an operational period of 15 months.
