Update: Here’s everything we know about the Western Downs murder case of Jonathan Martin, as his alleged killer remains in police custody.

A Toowoomba magistrate is trying to ensure the murder case of Miles man Jonathan Martin does not drag out before the courts.

Police charged Dale Joram Edward Hamilton, 26, with murder following a fatal and allegedly violent dispute at a Hawkins St home at Miles on March 21.

When officers attended the home about 9.30pm, they found Mr Martin, 44, unresponsive with a wound to his chest, and paramedics rushed him to Miles Hospital where he soon died.

Police allege the pair were known to each other, and a neighbourhood dispute sparked the alleged violent incident.

Magistrate Kyna Morice ordered the Queensland Police Service officers handling the case to straighten out their brief of evidence and provide updates on outstanding pieces of evidence.

The court was told despite the case being listed on Wednesday, September 20, for an update on crucial pieces of evidence that underpin the case, no updates were provided to police prosecution.

Ms Morice said if no update was provided to the court about the phone downloads (Cellebrite report), and the autopsy and DNA reports, the arresting officer was to appear in court to explain why.

She noted it was likely the DNA report would take time considering delays with the labs, however the autopsy report should have been disclosed.

Police claim Miles man Jonathan Martin died after an alleged neighbourhood dispute in March 2023.

Police prosecutor Sergeant Natalie Bugden said a number of statements were also outstanding from the brief of evidence, however they were not relevant in ensuring the case progressed.

The brief of evidence was ordered on March 27, less than a week after Mr Martin’s death.

Mr Hamilton is in police custody, however his legal representation, Legal Aid Queensland solicitor Phil Statham, was at court in his stead.

The case will be before the court on October 11.
