A man will remain behind bars after he was refused bail for the alleged stabbing of another man at a Dalby unit complex late last year.
Anthony Look, 70, who appeared in Dalby Magistrates Court via videolink, was arrested on October 12, 2022 after police alleged he stabbed his 46-year-old neighbour in the upper body following an altercation between the pair.
Defence lawyer Julia Molloy told the court her client claimed he had lived “peacefully” at the Pratten Street units prior to the victim moving in and making threats, which Mr Look had attended the police station to make complaints of.
“(The victim) was threatening to kill his animals and hurt him,” she said.
The court was told Mr Look claimed he went inside his home when he was approached by the victim the night of the alleged stabbing, with Ms Molloy telling the court it was her client’s instructions that the alleged victim inflicted the wounds on himself.
“(My client) is raising he didn’t do it,” she said.
Magistrate Kyna Morice told the court that Mr Look’s claims needed to be investigated further.
“You would appreciate it’s a bold submission to make,” Ms Morice said.
Ms Molloy said her client, who suffered mental health issues, had already been in custody for a significant amount of time.
“My client has been terrorised by this person, he doesn’t want to approach him,” she said.
Ms Morice emphasised the concern of both parties living near each other upon Mr Look’s release.
“If both parties suffer mental health issues, there’s a greater risk of something more sinister,” she said.
Police prosecutor Chris Hutchins highlighted Mr Look’s criminal history that included entries of serious assault of police, contravening direction and public nuisance charges.
“He clearly can’t behave properly in public,” Sergeant Hutchins said.
“They can’t be near each other, that wouldn’t be suitable.”
Ms Morice told the court she was not satisfied that cause had been shown to release Mr Look on bail and have him re-enter the community.
“There’s an unacceptable risk in my view that the victim would be placed in further danger,” she said.
Mr Look was refused bail and remanded in custody.
The matter is expected to be mentioned next on February 7, 2023.
