Mad driver claimed he had sex toy shoved in his face

THE man claimed people in another car had thrown rocks at his car before ramming his car on a road near Highfields.

The man claimed people in another car had rammed his vehicle.

A MAN who allegedly engaged in a dangerous car ramming manoeuvre on a busy Highfields road after being woken by having a sex toy waved in his face has been released from custody.

Defence solicitor Brad Skuse, of David Burns Lawyers, told Toowoomba Magistrates Court a person had pranked his client who woke to see a sex toy being waved in his faced which had triggered a flashback of him being sexually assaulted when a child.

The 47-year-old had left the home and witnesses claimed the car he was in and another car had been attempting to ram each other on Cawdor Road, Highfields, on February 9.

Mr Skuse said his client instructed he had jumped into his car but was followed by another car which had attempted to ram into him before they got out of the car and threw rocks at his client's vehicle.

It was then his client claimed the other car rammed into his car and he alighted from the vehicle and ran off, he said.

The man, who is not named due to allegedly being a victim of sexual abuse when a child, had made certain admissions to police and said he had been using ice in the lead-up to the matter.

Mr Skuse said his client's parole had been suspended and so he had remained in custody without an application for bail because he was serving out his previous sentence which was due to be completed later this week.

Mr Skuse made a fresh application for bail which was objected to by police.

Mr Skuse described the details of the matter as "very strange and unusual circumstances".

The man was not required to enter any pleas to charges of dangerous operation of a motor vehicle while adversely affected by a drug, disqualified driving, driving while under the influence of liquor or a drug, trespassing and wilful damage.

Mr Skuse said the people in the other vehicle had not been identified but conceded the case against his client was strong and that a number of witnesses had spoken to police.

However, his client could live with his partner for whom he was caring after she sustained serious injuries in a workplace incident.

A mental health report detailing his client's state of mind at the time of the incidents would have to be compiled which would take some time, Mr Skuse said.

Magistrate Kay Ryan said the matter was very serious and noted a number of other motorists on Cawdor Road at the time had had to take evasive action so as not to be involved in a collision.

However, Ms Ryan granted the man bail on condition he live with his partner, report to police and abide by all COVID-19 conditions.

The case was adjourned for mention back in the same court on May 25.
