ONE of the six people who were denied bail for their alleged involvement in a brutal bashing in Darwin on Christmas Eve is disputing the decision in the Supreme Court.

Karl Gruber, 19, appeared in the Darwin Supreme Court on Wednesday for a review of the decision by Judge John Neill in the Local Court last week.

It is alleged that Gruber was one of a group of six who were out on Darwin’s Mitchell St in the early hours of Christmas Eve before the alleged attack took place.

Gruber’s defence lawyer, James Stuchbery, said he intended to dispute the order of events as told by police “on the basis of observations made of the CCTV footage” as a part of the review.

He said CCTV footage of the incident would be provided to Justice Peter Barr so he could form a view.

However, Crown prosecutor Damien Jones said the Crown will allege that Gruber assaulted the victim “to the point where he is punched to the ground, he’s on the pavement.”

“The accused kicks him to the head. That assault is only stopped by, we say, a co-accused,” he said.

The matter was adjourned so that a suitable bail address could be found for Gruber in the case that he is granted bail.
