The court heard two people had provoked Morris, who was out celebrating co-accused Maea Tongamoa’s 24th birthday, before the group of six allegedly chased the two to where the bashing occurred, near the corner of Shadforth Ln and Peel St, some 200m away from the nightclub.

“We have the victim curled up in the foetal position to protect himself, two of the six run up and kick him in the back of the head, to the face, stomach, there is further kicking and punching,” Judge John Neill said.

“While all this is happening they continue by choking and punching him on the ground.

“ (Tongamoa) then uses his right leg in a stomping motion and stomps on the victim lying on the ground two times with great force.”

Recent Nhulunbuy Christian College graduate Ashleigh Epiha, 18, and disability worker Duol Gile-Lul, 27, were also refused bail over the incident, with all six facing charges of unlawfully causing serious harm and engaging in violent conduct.

It is alleged the group of six was made of two groups, with Wise and Gruber not known to Tongamoa and Gile-Lul.

Judge Neill said despite others intervening, the group had no hint of control, measured retaliation or awareness of the dangers of their behaviour.

“The group starts walking away, good Samaritans come over and put (the victim) in the recovery position, this offends the group of six,” he said.

“While the victim is in the recovery position, Tongamoa jumps in the air and stomps on his head which is resting against the kerb.” The six will return to Court on February 10.
